What are deemed universities?

In India, a Deemed university is an institute of higher education that has been recognized by the University Grants Commission (UGC) as meeting all standards of a university. At present, there are 45 deemed universities. The Ministry of Human Resource Development (MHRD), on behalf of the Government of India and UGC, is responsible for the designation and maintenance of standards in these universities. In order to become a deemed university, an institution must be certified by UGC that it fulfills all criteria and norms set forth in Section 3(1)(p) and Section 22(1)(g) of the UGC Act 1956.

How deemed universities got their status?

Article 21-A, part 2 of India's constitution, declares that no state government can prevent a state university from becoming a deemed university. Section 3(1) of The Deemed Universities Act of 1956 allows private institutions to seek a declaration from MHRD that they are deemed to be universities. This process has been streamlined and all it requires is for an institution to provide proof that it is 50 years old or older. Many institutions are declared universities but are not recognized as such by UGC under Section 22(3)(b) of The UGC Act, 1956. These so-called illegal deemed universities do not come under any statutory restrictions regarding fees, student selection process, or other academic matters.

What regulations are deemed universities must follow?

Deemed-to-be universities are granted academic and administrative autonomy without any legal entity of their own to manage their assets and liabilities. A deemed university is required to have at least three campuses. It must also set up a governing council, which shall manage its overall administration under a memorandum of association (MoA) that acts as its constitution. Each member of a governing council should hold office for three years or until he/she attains 70 years, whichever is earlier. This means that every member gets elected once in three years by different members of councils at all levels (local, regional and national). After each election cycle, members can be re-elected only once.

What is the procedure for declaring a private institute as a deemed university?

The procedure for declaring a private institute as the deemed university is specified under section 3(3) of the UGC Act, 1956. In general, for getting permission to declare a private institute as a deemed university, it is necessary that before applying for deemed status, there must be proposals from at least 15 colleges affiliated with it and all of them should be situated in different parts of India. Moreover, at least 5 recognized universities should support such an application.
